Section 12(3) of the Foreshores and Sea‑bed (Reclamations) Ordinance is confined to costs and remuneration incurred before delivery of a claim to the Director and does not oust the Lands Tribunal's ordinary discretion to award costs under the Lands Tribunal Ordinance; applying the principle of equivalence, the Applicant will not be ordered to pay costs of the preliminary issues now, those costs are reserved, Applicant must bear costs of amended pleadings, directions costs are in the cause, and the costs of the costs argument are the Applicant's costs in the cause.
