    The trustee (administrator) did not act unreasonably or for its own benefit; the litigation and subsequent application for leave to appeal were properly brought to protect the estate on counsel's advice and were not speculative. Therefore under Order 62 r.6(2) the Administrator is entitled to be indemnified out of the Estate for all costs incurred and for costs ordered to be paid to John Lee, including the costs of the application for leave to appeal.
