The conviction was quashed because the magistrate's reasons for rejecting the appellant's evidence were insufficient: the alternative explanation that the cashier may have omitted processing the cans was equally reasonable and the magistrate failed to give proper weight to the appellant's good character; consequently the conviction was unsafe. Costs on appeal are limited to legal costs properly incurred under statute and do not include loss of earnings; $400 ordered as costs.
