The Court has jurisdiction under s.83XX(2) to entertain a costs application made after an appeal has been allowed, but such late applications are disfavoured; exercising its discretion the Court will order an award of costs to compensate the appellant for expenses properly incurred in the specified proceedings and direct the Registrar to quantify the sums under Order 62 and s.83XX(4); costs of the appeal include the costs of today's argument.
