Because HCMP 120, which was the substantive action to which the NP Proceedings and joinder applications were ancillary, was settled by consent, the joinder applications and the variation summons were rendered superfluous; the tests for joinder under Order 15 r.6 could no longer be satisfied and the joinder applications were dismissed, with no order as to costs between the plaintiff and the intended 2nd defendant consistent with the consent order.
