The joinder applications were dismissed because the substantive proceedings (HCMP 120) had been settled and a consent order entered, which rendered the NP Proceedings and joinder applications superfluous; consequently the tests for joinder under Order 15 r.6 could not be satisfied post-settlement, and a costs order nisi of no order as to costs between the Plaintiff and the Intended 2nd Defendant was made to be consistent with the consent order.
