On the balance of probabilities the court found an oral agreement that Defendant would reconstruct the New Fence Wall to look like the Old Fence Wall and that Defendant would bear labour for finishing (tiling) while Plaintiff would source and pay for tiles; the alleged one‑foot brick foundation was not a term of the agreement and Plaintiff failed to prove defects caused by lack of foundation or poor workmanship as to entitle further damages; Defendant was liable to pay labour costs of HK$66,263.23 plus interest; costs order: no order (each party bears own costs).
