The magistrate was entitled to infer, on the prosecution evidence and in the absence of defence evidence, that the appellant knew or believed the instrument was false; the inclusion of an unnecessary element in the particulars and an otiose finding did not render the charge defective or the conviction unsafe; there was no reversal of the burden of proof; accordingly the appeal must be dismissed.
