The appellant's plea was voluntary and unequivocal and the admitted facts established the offence under the Immigration Ordinance; accordingly the conviction is upheld. However, because the appellant sought sentence review and may have misunderstood review versus appeal procedure, the court granted leave to appeal against sentence out of time and remitted the matter to the Magistrate to prepare findings on sentence.

The trial magistrate's factual findings that the appellant was aware of the Deportation Order, used a false memorandum knowingly, and re‑entered Hong Kong knowingly were upheld; those findings satisfied the prosecution burden beyond reasonable doubt, and the imposed sentences (concurrent on like deportation breaches and consecutive for the distinct false instrument offence) were within lawful discretion and not excessive.
