The court exercised its discretion under Rule 44(12) of the Non-Contentious Probate Rules to clear the caveat and to grant limited letters of administration to the Chartered Bank Hong Kong Trustee Limited as an exceptional case because the caveator did not dispute the right to a grant generally and only contested devolution of the 45 shares; the grant is limited until the infants obtain a like grant and the caveator may pursue separate proceedings on the disputed shares.
