    The Court of Appeal held that the Family Court judge committed procedural irregularity by varying maintenance pending suit at a hearing that was confined to summonses for particulars without putting that issue clearly to the parties and inviting their views; the interim maintenance order of HK$10,000 plus outgoings dated 11 July 2003 was set aside with liberty to re-apply, but the judge's order of no order as to costs relating to the hearings was upheld and the appeal was allowed in part.
