The Court of Appeal allowed the appeal because the dispute was not merely academic: the 13 April 2002 decision formed part of a series of recurring permissions and the issue whether affected PLB operators must be consulted was sufficiently likely to arise again; the Commissioner ought to have disclosed the full history of prior approvals; in public law the court may exercise its discretion to determine such issues in the public interest and order relief and costs accordingly.
