On the evidence the court found the Impugned Documents were created on or after 29 September 2022 and backdated to 12-13 September 2022; as Tina and Albert had been removed by then they lacked authority and the documents are void for want of authority; alternatively, even if executed before removal, the 1st transfers, allotments and appointments were procured in breach of fiduciary duties (improper purpose/dilution) and are voidable; CISIL and MS had knowledge or were nominees so attribution of knowledge applies; consequential declarations and relief and costs follow.
