The appellate court concluded the magistrate properly evaluated the evidence and credibility, was not plainly wrong in rejecting the appellant's account, had considered the appellant's clear record and propensity and the law on dishonesty, and therefore the inference of dishonest intent was properly drawn and the conviction must stand.

The magistrate legitimately accepted the prosecution's credible eyewitness account, found inconsistencies and inadequate factual basis in the psychiatric report, and reasonably concluded beyond reasonable doubt that the appellant acted consciously with dishonest intent to permanently deprive the shop of the goods; thus the conviction stands.

The conviction was unsafe because the learned magistrate materially erred by treating the issue of sole proprietorship as a negative averment and thereby shifting the legal burden to the appellant; that misdirection was fundamental to the finding that the appellant made or concurred in making the invoices and therefore amounted to a material irregularity warranting quashing of the conviction.

Appeal allowed and conviction quashed because the appellant was disallowed to give evidence; however, because there was sufficient prima facie evidence of the alleged offence the matter must be remitted for retrial by another Magistrate to ensure justice is done and seen to be done.
