The court held that special reasons were established for the appellant because the absence of insurance resulted from the agent's default and the appellant reasonably relied on the lender's apparent and demonstrable practice of keeping vehicles insured; it would be inconsistent to find special reasons for the owner but deny them to the bona fide user, and accordingly the disqualification was quashed.

On the evidence the court was satisfied the appellant was uninsured for the offending conduct and his guilty plea and conviction were upheld, but because of mitigating factors (first convictions, employment circumstances, unclear oral insurance variation, language barrier and habitual passenger-carrying) there were special reasons to reduce the 12-month driving disqualification to a period of two months.
