On the undisputed documentary admissions, payroll records, work permit applications and identification evidence the court concluded R1 was the employer of the eight deceased and R2 was the principal contractor; the deaths occurred in the course of employment and thus arose out of employment under s.5(4)(a); accordingly both respondents are liable and statutory compensation was assessed under s.6 with earnings computed per s.11 and apportioned under Schedule 7; funeral expenses, interest and costs awarded as specified; indemnity claim by R2 against R1 to be heard subsequently.
