On rehearing the court accepted the Magistrate's credibility findings and held that the appellant's repeated transfer of a large quantity of perishable vegetables late at night, together with his recognizance status and the improbability of personal use, supported an irresistible inference of employment beyond reasonable doubt, so the conviction was upheld.

Given the proven primary facts — three defendants performing distinct, interdependent tasks in a small commercial kitchen with no one else present and the prosecution witness found honest and reliable — the only reasonable and irresistible inference was that each defendant was employed in the caf/kiosk, and the convictions are safe and must be affirmed.

Although the Magistrate applied the correct tariffs and was justified in declining suspension initially, the detailed second Social Welfare Report established wholly exceptional humanitarian circumstances — the wife's moderate depressive episode, fainting and other medical conditions and the children's vulnerability — which, together with the appellant's plea and remorse, warranted mercy; the Court allowed the appeal in part and reduced the sentence to 4 months imprisonment to permit immediate release.

The sentencing magistrate correctly applied established sentencing guidelines, adopted a 22-month starting point for each offence and reduced each sentence to 15 months for the guilty plea; concurrent sentencing was appropriate; family hardship and the appellant's medical complaints do not justify reducing the properly imposed sentence, therefore the appeal is dismissed.

The deputy magistrate correctly applied the Usman Butt guideline, used an elevated starting point because the appellant was convicted after trial, properly credited 165 days administrative detention, found no mitigating factors and imposed 17 months imprisonment; the High Court dismissed the appeal against sentence accordingly.

The appeal is dismissed because the Magistrate correctly applied the guideline sentence of 15 months for the offence, properly concluded s67A did not entitle the appellant to a statutory deduction while allowing a one month reduction for the period of administrative detention, and properly activated the suspended 2-week sentence; the resulting sentence of 14 months plus 2 weeks was not manifestly excessive.

The appeal was dismissed because the magistrate was entitled to find the post record admission voluntary and admissible, to accept PW1's credible evidence of observation that the appellant was working with a screwdriver, and to rely on Admitted Facts establishing a removal order; those findings provided sufficient evidence to convict beyond reasonable doubt, so the conviction was not unsafe.
