The Court held that the husband had provided the purchase money and acquired the entire beneficial interest by resulting trust, that the purchaser (through her agent) had actual knowledge of the husband's occupation and made no inquiry and therefore was constructively notified of his equitable interest per Boland, and accordingly the purchaser took subject to the husband's rights and must transfer the premises to him.
