The deputy magistrate did not err in treating the accused's failure to make immediate complaints as admissible and relevant to the limited issue of whether the alleged confessions were voluntary; the magistrate's findings were supported by the evidence as a whole and the applicant's contentions were not reasonably arguable, so leave to appeal was refused.

In a judge-alone criminal trial the trial judge was entitled to regard the appellants' failure to give sworn evidence as strengthening the prosecution's inference of bribery where the only explanations were extra-judicial statements rejected by the judge and the matters were within the accused's peculiar knowledge; such reasoning did not breach the right to silence and the appeals were to be dismissed, while noting that in jury trials stronger comment is normally exceptional and must be given with caution.

The Magistrate's acceptance of the independent passenger's evidence and his factual findings that the bus cut into the taxi's lane established a material departure from the standard of a reasonable driver; the appellate court found no error in those credibility and factual findings and therefore dismissed the appeal.
