The trial judge reasonably accepted PW2's evidence that he observed and continuously followed the assailant for an extended period in circumstances that made reliable identification possible; inconsistencies between witnesses were minor and explicable; no proper basis existed to disturb the trial judge's findings, so the conviction was safe and must be upheld.

On the evidence the Court was not satisfied that the Appellant's driving fell so far below the expected standard as to be dangerous; expert and circumstantial evidence supported low speed and possible obscuration of the deceased; the magistrate erred in treating PW1's testimony as excluding all other reasonable inferences. Appeal allowed, dangerous driving conviction quashed and substituted with careless driving.

The Court held the Magistrate properly considered and applied the Turnbull guidelines, evaluated lighting, clothing uniformity, viewing times, delay and contradictions, concluded the identifying witness was truthful and deliberately focused on the servers, and that the convictions based on that identification were safe; the appeal was dismissed.

The trial judge correctly exercised his fact-finding and credibility functions in accepting the cautioned admissions as voluntary and reliable and in finding that those admissions, together with the evidence, established guilt for arson and conspiracy to blackmail; there was no basis for the Court of Appeal to overturn the convictions and leave to appeal was refused.
