Applicant failed to identify any error of law, irrationality or procedural unfairness in the TCAB decision; in absence of such defects the court will not substitute its own factual conclusions and thus dismissed the application for leave to apply for judicial review.

The appellate court found that the magistrate failed properly to interpret and test the appellant's evidence about his turning manoeuvre and failed to consider the limited geographical scope of the no‑right‑turn signs; because the appellant's account that he completed the manoeuvre after passing the signage could be true or possibly true, there remained a reasonable doubt whether he contravened the signs, and the conviction and fine were quashed.

Applicants' grounds were largely repetitive of arguments already rejected by the trial judge and failed to identify any specific legal or factual errors of sufficient prospect of success; the trial judge's factual assessments and reasons were reasonable and not manifestly wrong; consequently leave to appeal was refused and costs ordered.
