Leave to apply for judicial review was refused because the applicant demonstrated no exceptional circumstances to challenge the Director's decision and the Board's adverse credibility findings were justified by the applicant's deliberate refusal to cooperate, rendering any judicial review application without reasonable prospect of success.

On the balance of probabilities the court found the bankrupt had materially concealed assets and failed to cooperate with trustees in the administration of the estate, establishing the trustees' grounds under section 30A; therefore the automatic discharge was suspended for four years to permit investigation and realisation of assets and to protect public interest; costs were awarded to the trustees.

The court found established lack of cooperation and post-bankruptcy unsatisfactory conduct in relation to failure to provide sufficient banking information, failure to assist with foreign property enquiries, unsatisfactory communication methods and failure to make agreed contributions; these grounds justified suspending the running of the relevant period under s30A, but the misconduct was not so serious as to merit the maximum four-year suspension, and a two-year suspension was proportionate.

The Trustees proved the bankrupt had failed to cooperate and engaged in unsatisfactory conduct after commencement of the bankruptcy (late annual statements and failure to report employment); ignorance of law did not excuse these failures; although the bankrupt subsequently remedied the defaults and creditors suffered no real prejudice, suspension of discharge for a limited period was justified; discharge deferred for three months to 2 March 2007.
