The appeal was allowed because the magistrate's statements that he did not believe a police officer would frame the appellant indicated bias in favour of the police and against the appellant; convictions based on the impugned officer's evidence were therefore unsafe and were set aside.

Because no application for a summons was made and the statutory duty to issue a summons is triggered only if it is "made to appear" to the magistrate, he was not obliged to summon P.C. 10212; further, the magistrate's specific findings of fact demonstrated that he considered the elements of obstruction and careless driving and were sufficient to support the convictions, so the appeal is dismissed.

Where a driver in possession of his licence drives off after being required to produce it, drags a constable clinging to the vehicle through heavy traffic and thereafter strikes the constable causing him to fall, the constable was acting in the execution of his duty and the driver's conduct constitutes assault and dangerous driving; an asserted brake defect was insufficient to justify or excuse the conduct on the facts.
