Defendants failed to particularise incidents sufficient to ground a general discovery order; discovery in libel cases where justification is pleaded is limited to documents relating to incidents the defendant has already particularised. Therefore the general application for a further and better list and broad discovery was dismissed, but limited disclosure was ordered only in respect of companies and documents which the defendants had adequately particularised (Robina Department Store and Robin Construction) and a narrow affidavit requirement imposed.
