The court found plaintiffs established a good arguable case that the defendant breached directors' duties through suspicious rice contracts, improper payments to Innomind and unauthorised gratuities; the defendant's emigration to Australia coupled with incomplete and unsatisfactory asset disclosure established a real risk of dissipation; on balance of convenience the Mareva injunctions should be continued until trial or further order, with a monetary credit of HK$3,039,840 to be applied to the limit in HCA 1333/2023 and costs awarded to the plaintiffs.
