The commencement of these proceedings was inappropriate and unnecessary in light of an available alternative internal review remedy which the applicant failed to exhaust; the applicant delayed withdrawal until after the respondent had incurred substantial preparatory costs under court directions, and therefore the court exercised its discretion to order the applicant to pay the respondent’s costs up to and including the respondent’s solicitors' letter dated 27 May 2022 on a party and party basis, to be taxed if not agreed.
