Relief against re-entry should be granted in the exercise of the court's equitable discretion where the breach was not wilful, the lessee made some albeit imperfect attempts to purge the breach, the structure straddling government and private land justified additional reasonable time, and the balance of factors favoured granting relief subject to payment of government enforcement costs and indemnity costs of these proceedings; accordingly relief was granted on specified terms including payment of costs before re‑vesting is effected.
