Defendant failed to discharge the burden of proving exceptional circumstances to justify departing from the prima facie entitlement to District Court scale costs; prior warning was given but the plaintiff had reasonable grounds to commence in the District Court and lacked benefit of later authorities, therefore costs are to be assessed at the District Court scale but summarily assessed as disproportionate and excessive, fixed at HK$15,000.
