Defendant failed to prove the plaintiff carried on a business of money-lending (insufficient number and quality of transactions), so the licence issue did not arise; however the effective interest charged (4% per month on net advance) was harsh and unconscionable and justified reopening the two transactions and treating $1,000 of interest already paid as part payment, reducing the judgment to $1,900.
