Although the magistrate properly sentenced the appellant and the sentence was appropriate for the offence, the Court exercised its discretion on humanitarian grounds and, because the appellant had served a considerable portion of the sentence and corroborative information from Pakistan was not forthcoming in a reasonable time, varied the sentence to permit the appellant's immediate release.
