The court held that ICAC Chief Investigator Morris was acting within s10(2) of the ICAC Ordinance during an ongoing corruption investigation and, combined with the 14 March 1979 section 12 authorisation, was lawfully empowered to lay informations which were deemed to be laid on behalf of the Attorney General; GN 1818 did not revoke those authorisations and therefore the informations and committal proceedings were valid; Saied J.'s ex parte stay was set aside and the stay lifted.
