LEE YORK FAI v. YUE SHIN MAN ANNA

    Citation
LEE YORK FAI v. YUE SHIN MAN ANNA
    Court
    Court of First Instance
    Case number
    HCA4305/2003

The court found the defendant uttered words referring to those who distributed the balloons and not to the plaintiff; the plaintiff failed to plead the connecting facts necessary to show the defendant's words were published of him; the Apple Daily Report did not accurately repeat the defendant; even if the defendant's words had been published of the plaintiff, justification was established because the plaintiff had in fact distributed balloons without HKHA approval in breach of the Guidelines; accordingly the plaintiff's defamation claim fails.
