On the pleadings the court was satisfied the 1st defendant, acting under a power of attorney and retainer, entered into an extraordinarily long low-rent tenancy without the plaintiff's knowledge or consent and failed to inform the plaintiff or procure possession for the tenant; that conduct constituted a breach of fiduciary duty; accordingly the plaintiff was entitled to rescind the Purported Tenancy Agreement and obtain a declaratory order and an indemnity for the stamp duty; costs were awarded to the plaintiff with the cost of preparing the supporting affirmation disallowed.
