Because the defendant's appeal and attempts to stay the order have been finally dismissed, the contingent basis for the indemnity and the payment into court no longer exists; therefore there is no need for continued fortification and the Court must release the Sum to the plaintiff, and allegations relating to the merits are res judicata and do not prevent release.
