The Court granted conditional leave to appeal limited to Grounds 1, 1A and 4 on the basis that the Respondent must (a) give undertakings to the Incorporated Owners and to the Court not to use the lobby and the three lifts and to use the rear staircase only as emergency exits, (b) pay all costs incurred in the Tribunal and before the Court and not seek costs against the Incorporated Owners, and (c) confirm acceptance within specified time limits; compliance entitled the Respondent to file a Notice of Appeal confined to the limited grounds, otherwise the application for leave would be dismissed.
