Where a judgment creditor holds a final judgment and a garnishee holds funds owed to the judgment debtor, the court will order the garnishee to pay those funds to the judgment creditor and may order enforcement costs (assessed at $5,200) to be added to the judgment debt and retained out of recovered monies in priority.

On the balance of probabilities the applicant remained under a continuing threat justifying injunctive protection, but the evidence did not justify continuation on the same terms for the maximum statutory period nor continuation of the authorisation of arrest; therefore the interim injunction was varied to a fixed 6‑month duration, the authorisation of arrest was removed, substituted service by advertisement was ordered and costs were awarded to the applicant.

Because the defendants' summonses were not wholly hopeless and raised arguable points, the court declined to make separate costs awards for the failed summonses and retained the broad order made with the order nisi, but ordered that the appropriate costs order for this particular application/hearing is that the defendants have their costs in the cause.
