On the pleaded facts, which in the absence of any defence are taken to be admitted, the plaintiff established sufficient goodwill, the defendants' registered names were calculated to and likely did cause confusion with the plaintiff, and the plaintiff would suffer damage; accordingly the court exercised its discretion to grant injunctions in default and awarded costs in favour of the plaintiff.
