Although the defendants intermeddled with estate assets and did not follow statutory procedures precisely, there was no evidence of dishonest misappropriation and the assets were accounted for and available; given the simple nature of the estate, the 1st defendant's residence in Hong Kong, his familiarity with the deceased's affairs and majority beneficiary support, the court exercised its discretion under s36 PAO to appoint the 1st defendant as sole administrator.
