Although the insurer is an 'interested person' under Rule 24(1) and liable under ss.43(1) and 44(1) of the Employees Compensation Ordinance, the court will not exercise its discretion to join the insurer because joinder would serve no purpose in resolving the applicants' compensation claim and would be driven by the respondent's private contractual dispute with the insurer; the insurer's statutory obligations allow claimants to enforce awards directly and the employer and insurer may resolve their dispute separately (including by arbitration).
