The court refused leave and excluded Mr. Chan's supplemental report and all his expert evidence because the Institute failed to discharge the burden of showing Mr. Chan was a reliable, impartial and independent expert aware of and able to discharge his duties: material non‑disclosure about KCS's role and the provenance and completeness of the October 2005 survey report, apparent conflicts of interest and cavalier conduct in complying with court expert directions undermined the probative value and admissibility of his evidence.
