The court, exercising its discretion after review of the written judgment and submissions and in light of the abandonment of the appeal, ordered no costs for the interrogation summons dated 17 March 2009, and ordered that the costs of the specification summons dated 27 April 2009 be to the plaintiffs and, if not agreed, to be taxed and paid forthwith by the 1st and 2nd defendants on a common fund basis.
