The court held that the Ghosh-based test as affirmed in Mo Yuk Ping remains the binding test for dishonesty in criminal cases in Hong Kong; the factual findings established the applicant’s conduct was dishonest under either Ghosh or Ivey; therefore the application for a certificate under Cap.484 s32(2) did not raise a legal point of general public importance warranting a certificate and was refused.
