The claims were in substance for recovery of unauthorised overpayments of wages and reimbursements which are expressed terms in the employment contracts and therefore fall within the Labour Tribunal's exclusive jurisdiction; the plaintiffs' re‑characterisation as equitable/fiduciary claims was window-dressing and an abuse of process, so the District Court action must be struck out with costs.
