The court held that by completing and submitting the application form on 18 May 1984 the plaintiff entered into a bilateral contract obliging it to surrender the specified Letters B, and the Government accepted that offer by its conduct and letter of 26 May 1984; the plaintiff could not validly withdraw the application in April 1985 and failure to produce original letters did not discharge the contractual obligation (the Government could waive production). The originating summons was dismissed.
