The court exercised its case-management discretion to permit the plaintiff to adduce the limited, relevant late documents and the plaintiff's wife's affirmation and to admit the plaintiff's eldest sister's witness statement because there was no prejudice, no bad faith and no disruption to the trial timetable; conversely the court refused the defendants leave to file three additional witness statements because they merely adopted existing evidence and one witness was not available for cross-examination, making the statements hollow and inadmissible; no order as to costs was made.
