The court held that the 'arbitration factor' — namely that overseas counsel had conducted (or had substantial involvement in) the underlying arbitration proceedings — is a relevant and substantial factor in deciding applications under section 27(4) LPO and where present can be decisive in admitting that counsel to appear in related court proceedings, subject to limits (counsel's standing, relevance to a substantial matter, and proper evidential basis for factual issues). Applying that principle, the court admitted the applicant.
