The judge concluded defendants were substantially successful (90%) and, applying the principle that costs follow the event and exercising judicial discretion, ordered the plaintiff to pay 80% of the 1st and 2nd defendants' costs of the review proceedings (including preparation of written submissions), declined to vary or decide the adjourned summons which was not properly before him, allowed only the site visit fees (HK$37,500), and accepted that costs arising from the authorised reviews will be borne by the Legal Aid Fund under the Legal Aid (Scale of Fees) Regulations.
