The 1st defendant failed to establish adverse possession because the parents occupied the pitch as government fixed‑pitch hawker licence holders governed by the Hawker By‑laws and licence conditions; such occupation was by licence (not in their own right), subject to regulatory control and revocation, and objectively lacked the requisite animus possidendi to exclude the paper title owner; accordingly the claim to possessory title failed and the plaintiffs’ possession order was granted.
