The Court of Appeal upheld the Beddoe order because the administrator established a reasonably arguable case that the 2nd defendant, as authorised signatory, owed fiduciary duties and authorised withdrawals totalling HK$36.49m favouring himself and his wife and must account; issues of gift, possession for limitation, and resulting trust are matters for trial and do not constitute a knockout point to defeat the Beddoe application.
