Because the uncontested fresh evidence established that the appellant's guilty plea was induced by duress (a nullity) and the forensic report contradicted the alleged confession, the respondent conceded and the Court had jurisdiction to entertain the appeal under the nullity principle; therefore the appeal is allowed and the conviction and sentence are set aside.
